A building needs a dedicated file for later work that remains useful beyond the construction phase. Section 8 of the Austrian Construction Work Coordination Act, or BauKG, requires the building owner to ensure that the file is prepared, updated when changes occur and stored appropriately for the life of the building.

The file contains building characteristics that workers must take into account to protect safety and health during use, maintenance, upkeep, alterations or demolition. Examples include access points, anchor points, scaffold anchoring points and gas, water or electricity lines.

If the building is handed over during construction or after completion to another natural or legal person or to another company with legal personality, that recipient must ensure storage of the file. What the file under section 8 BauKG is for

Section 8(1) BauKG requires the building owner to ensure that a file for later work on the building is prepared. The duty therefore concerns a document that supports safe work on the completed building or on a building that is later altered.

The purpose follows from section 8(2) BauKG. The file must record those characteristics of the building that workers need to take into account during later work. The provision identifies use, maintenance, upkeep, alteration work and demolition as examples.

The file therefore describes safety-relevant features of the particular building. A general collection of project documents serves this purpose only when the information relevant to later work can be found and understood within that collection.

Which technical information belongs in the file

Section 8(2) BauKG requires information about building characteristics needed to protect safety and health during later work. The provision expressly mentions access points, anchor points and scaffold anchoring points. It also names gas, water and electricity lines.

For practical use, assign each item to the relevant building part and plan status. A company carrying out later work should be able to identify an access point, locate an anchor point and understand which utility route must be considered before work begins.

The provision does not prescribe a particular file format. A digital file, a set of plans or another suitable form of documentation may be sufficient where content, currency and access are reliably organised. If several versions exist, mark which version is current.

When the file must be prepared and updated

Section 8(3) BauKG requires the file to be prepared during the preparation phase. Safety information should therefore be incorporated into planning before later work on the building has to be organised under more difficult conditions.

Section 8(4) BauKG requires updates as the works progress or when changes occur. This includes changes to the building or its technical features that matter for later use, maintenance, upkeep, alteration work or demolition.

Section 8(5) BauKG requires the file to be taken into account during both the preparation and execution phases. The documentation should therefore be compared with construction progress and should continue beyond an early planning status.

What happens to storage after a change of owner

Section 8(6) BauKG requires the building owner to store the file appropriately for the life of the building. The storage duty is designed to keep the information usable over the long term.

If the building is handed over by the building owner during construction or after completion to another natural or legal person or to another company with legal personality, that recipient must ensure storage of the file. The transfer is linked to the handover of the building.

A practical handover record should state the version, date, recipient and storage location. Section 8(6) BauKG regulates storage of the file. The other rights and duties connected with a transfer of ownership depend on the contracts and the remaining applicable provisions.

How the file differs from the construction file and a warranty review

A construction file generally collects documents about the building procedure, permits, plans, decisions and execution. The file under section 8 BauKG has a separate purpose: it brings together the characteristics required for safe later work. Individual plans or findings may appear in both records, while their functions remain different.

The appointment of a safety and health coordinator addresses another question. It concerns coordination during the legally relevant construction phases. The maintenance file is directed at information that must be considered during later work on the building.

The file also does not replace a warranty review of the construction. Whether the building was completed defectively, which claims exist and how evidence should be preserved requires a separate technical and legal assessment.
