A new balcony or glazed loggia often affects the façade, common parts and condominium documents. An offer from a contractor or informal consent of individual neighbours is therefore rarely enough.

Austrian condominium law, building law, condominium documentation and actual construction details interact. Separating these levels helps avoid removal, cost disputes and blocked projects.

This article focuses on balcony and loggia changes. It does not repeat the general articles on condominium alterations, pergolas or loft conversions.

Separate condominium consent and building law

For a balcony or loggia, first clarify whether the measure affects common parts, external appearance or interests of other owners. Section 16 WEG is the condominium law starting point.

In addition, a building permit or notification may be required. Consent within the condominium does not automatically replace the authority procedure, and a permit does not replace every condominium consent.

Cases are particularly sensitive where condominium documents, useful value allocation or façade design may be affected.

Which documents matter before approval

Useful documents include current plans, condominium documentation, useful value records, façade photos, a technical description, offers and a clear authority status.

For loggia glazing, daylight, fire safety, sound, condensation and external appearance may also matter. These points should not first be discussed after installation.

The clearer the project status is documented, the better it can be decided whether consent, application, contract change or refusal is the right next step.

Avoid removal, cost disputes and neighbour conflict

The greatest risk is not always the construction itself, but unclear approval. Starting without a clean basis can trigger injunctions, removal, extra costs and long disputes.

Conversely, a refusal should also be well reasoned. Blanket objections can harden negotiation without strengthening the legal position.

Not always in the same form, but if common parts, the façade or protected interests of other owners are affected, the condominium law level must be reviewed carefully.

Does a building permit replace consent under condominium law? +

No. Building law and condominium law are separate levels. An authority permit does not automatically resolve all civil-law questions.

Should I obtain legal review before applying? +

Yes, if the façade, condominium documents, neighbours or cost risks are involved. After construction has started, the negotiating position is usually weaker.
