Demolition is often the first visible construction phase. Legally, it is rarely only preparation because permits, neighbouring buildings, evidence preservation, heritage issues and disposal can come together.

Starting demolition without a clear basis can create more than an authority problem. Neighbours, contract partners and later evidence issues can burden the new build or renovation.

This article covers voluntary demolition before new construction or renovation and distinguishes it from buying a demolition property and from an authority demolition order.

Assess your position

What should be clarified before the next step?

Answer two short questions for initial orientation on documents, risk and next step.

01 Question 1

Where do you stand now?

The right response depends on whether you are still planning, already building or already reacting to a dispute.

All paths at a glance

Overview of all answers.

01

Before implementation, the risk can usually be managed best.

Review Demolition before new construction or renovation before instructing works, paying or starting construction, based on contract, plans and authority status.

This preserves room for negotiation, evidence and legal position.

02

With complete documents the next step can be set precisely.

If the documents are complete, claim, evidence and response can be reviewed separately.

The next response can then be prepared in writing and in a traceable way.

03

Missing documents should be closed first.

If files, photos or plans are missing, the facts should be secured first.

Only then is a reliable legal assessment possible.

04

Do not wait where dispute, deadlines or payment pressure exist.

If deadlines, a construction stop, costs or court steps are threatened, a general assessment is no longer enough.

Claim, evidence and next step must be reviewed specifically.

Clarify procedural status before demolition

Under Salzburg construction law, demolition may require a permit or notification depending on object, location and planned follow-up works. A blanket statement without file status is risky.

Review existing consent, conditions, protection status and whether demolition forms part of a larger construction project.

For old-town properties or protected buildings, heritage or preservation issues must also be considered.

Take neighbouring buildings and immissions seriously

Demolition creates vibration, dust, noise and risk for adjacent structures. Especially in dense development, the condition of neighbouring buildings should be documented before work starts.

Photos, minutes, crack monitoring and clear site communication help assess later allegations. This does not replace technical supervision, but it strengthens evidence.

Informing neighbours only after complaints have arrived starts from a weak communication position.

Treat disposal and contract as legal issues too

Disposal, pollutants and separation of materials must be planned technically. Legally important is who assumes which obligation, which evidence is required and what applies to unexpected findings.

The contract should define scope, safety measures, documentation duties and the response to extra costs clearly.

This article does not invent disposal thresholds. It shows which legal review points should be clarified before starting.

Assessment

Classifying demolition before construction or renovation

The overview shows which practical questions should be kept apart.

Classifying demolition before construction or renovation
Level What it concerns Typical risk
Authority Authority Permit, notification, conditions and file status Stop or later conflict with authority
Neighbours Neighbours Vibration, dust, noise and damage Evidence dispute about condition and cause
Contract Contract Scope, safety measures and disposal Extra costs and unclear responsibility

The specific assessment depends on contract, documents and procedural status.

Approach

A safe practical sequence

This sequence helps prepare the matter in a structured way.

  1. 01
    Step 1

    Secure documents

Collect contract, plans, photos, authority decisions and correspondence before making the next statement.

  2. 02
    Step 2

    Separate legal bases

Separate authority, contract, neighbours and evidence.

Separate authority, contract, neighbours and evidence. This shows which legal track supports the next step.

  3. 03
    Step 3

    Prepare written response

Record the next step in writing and avoid statements that could later be read as acknowledgement.

Practical tip: Do not review only the technical solution. The decisive point is which legal level supports the next step. For ongoing construction-law updates, you can subscribe to the Brandauer newsletter. If you would like to discuss your case, you can book an initial consultation (72 euros).

FAQ

Demolition before new construction or renovation: permit, neighbours and disposal risks.

Does demolition in Salzburg always require a permit? +

That depends on the object, location and connection with the follow-up project. Without file status, one should not assume either permit-free or permit-required demolition as a blanket rule.

Why is evidence preservation before demolition important? +

Because the original condition often can no longer be checked once works have started. This concerns your own elements, neighbouring buildings, cracks and later damage allegations.

May I start demolition before the new build is permitted? +

This must be reviewed separately. Demolition and new construction can be connected procedurally and contractually, but they are not automatically the same issue.
